Terms of Service

These Terms of Service govern your use of the Tales website, iPhone app, and related services operated by Available Pretext Lda. By using Tales, you agree to these Terms.

If you do not agree to these Terms, do not use Tales. If you are using Tales on behalf of a child, family member, or another person, you are responsible for ensuring you have authority to do so.

1. Eligibility and Accounts

Tales is intended for use by parents, guardians, and other adults creating bedtime stories for children and families. You must comply with applicable law and any additional terms imposed by Apple, Google, or other platforms you use to access Tales.

You are responsible for maintaining the security of your account and devices, for the accuracy of information you provide, and for all activity occurring through your account. Tales currently supports sign-in using Apple and Google. We may add, remove, or change authentication methods over time.

2. The Tales Service

Tales provides tools for creating personalized bedtime stories using a combination of account services, local device capabilities, optional iCloud sync, cloud-based story generation, and App Store subscription handling. Features may vary by device, operating system version, region, subscription tier, or temporary service availability.

Some story-generation features may run locally on supported Apple devices, while others may use Tales backend services and third-party AI providers. We do not guarantee that every feature will always be available or that locally generated and cloud-generated outputs will behave identically.

3. Subscriptions, Story Packs, and Billing

Tales may offer recurring subscriptions, such as a Plus tier, and may also offer other in-app purchases such as story packs or credit-based products. Pricing, benefits, and entitlements may change over time.

Purchases made through the iPhone app are billed by Apple through the App Store, not through this website. Subscription management, cancellation, refunds, billing disputes, payment methods, and renewal handling are subject to Apple's terms and policies in addition to these Terms.

Unless Apple states otherwise, subscriptions may renew automatically until canceled. You are responsible for reviewing your App Store subscription settings and managing renewals there.

4. Your Content

You may submit prompts, child-related details, character information, photos, and other inputs to use the service. You retain whatever rights you already have in the content you submit, but you grant us a limited, non-exclusive right to host, process, transmit, store, transform, and display that content as needed to operate, secure, and improve Tales.

You represent that you have the necessary rights and permissions to provide any names, photos, likenesses, and other information you submit, including when that information relates to a child or another person.

Generated outputs may not be unique and may resemble outputs generated for other users. Except where we expressly agree otherwise, Tales is provided for personal, family, and non-commercial use.

5. Acceptable Use

You agree not to:

• use Tales in violation of law or the rights of others;
• submit content you do not have the right to use;
• upload harmful, abusive, infringing, deceptive, or unlawful material;
• attempt to interfere with, probe, scrape, reverse engineer, or disrupt the service;
• circumvent account, rate-limit, purchase, or safety controls;
• use Tales to create content that is unsafe for children, sexually explicit, hateful, violent, or otherwise inconsistent with the intended family use of the service.

6. AI and Generated Content

Tales uses automated systems and AI-assisted tools to help generate stories and illustrations. Generated outputs can be incomplete, inaccurate, unexpected, or unsuitable for your intended use. You are responsible for reviewing output before sharing it with a child or anyone else.

Tales is not a source of legal, medical, educational, therapeutic, or safety advice, and generated content should not be relied on as professional guidance.

7. Availability, Changes, and Storage

We may add, modify, suspend, or remove features at any time. We may set or change limits relating to storage, sync, story generation, subscription entitlements, supported illustration styles, or supported devices.

Certain backend-generated story records and uploaded assets are intentionally temporary and may expire or be deleted automatically according to the service's retention settings, even if a local device copy remains available in your app.

8. Suspension and Termination

We may suspend or terminate access to Tales if we believe you have violated these Terms, created risk for the service or others, engaged in fraud or abuse, or if we are required to do so by law.

You may stop using Tales at any time. The app also includes account sign-out and account-deletion controls. Under the current app flow, account deletion is intended to delete the backend account and associated app data under our control. Deleting your Tales account does not automatically cancel your App Store subscription; that must still be managed through Apple.

9. Intellectual Property

Tales, including the app, website, branding, software, and service design, is owned by Available Pretext Lda or its licensors and is protected by intellectual property laws. These Terms give you a limited, revocable, non-transferable license to use the service for its intended personal and family purpose.

10. Disclaimers

To the fullest extent permitted by applicable law, Tales is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, error-free performance, perfect content accuracy, or that every output will meet your expectations or requirements.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Available Pretext Lda and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity arising from or related to Tales.

Nothing in these Terms limits rights that cannot be excluded under applicable consumer law, or liability that cannot be limited by law.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the app, website, or other reasonable means. Your continued use of Tales after updated Terms take effect means you accept them.
